What is an Appeal?

After a final decision, such as a judgment or final order, is rendered in
a civil case by a trial judge or jury, the party who "loses" generally has
the right to have the decision reviewed by a higher court.  This
process is known as the Appeal or Appellate process.

Appellate courts are for appellate decisions only.  Arguing an appeal
is quite different from representing a party in a trial.  A party who
disagrees with a judge's or jury's decision should seek the advice of
an experienced appellate lawyer, such as the Appellate Law Firm of

appeal of their case.  Likewise, a party that is served with a notice

What are the Differences between a Trial and an Appeal?

There are significant differences in objectives, procedures and
dynamics between trial court proceedings, and the process of
appellate review. Unlike a trial, the purpose of an appeal is not to
determine the case on its merits, but to review for trial court error.  
The appellate process is not for trying a case from the ground up but
rather, for reviewing action taken in the trial court. The Courts of
Appeal do not replace the trial courts as the original forum for
consideration of the facts and evidence; nor do the Courts of Appeal
reweigh the evidence, or reassess witness credibility.   

When Should an Appellate Attorney be Retained?  

The decision to retain an appellate specialist should be made at the
earliest possible time, the sooner the better.  Often, an appellate
expert participates in post-judgment proceedings in the trial court
(exploring further trial court remedies before proceeding with an
appeal, drafting the notice of appeal, assisting in designation of the
record on appeal, and participating in post-judgment settlement
negotiations).
